1. Ownership of Content and Intellectual Property

- Software & Design: Web app source code, user interface (UI) design, visual layout, software architecture, and custom features.
- Original Content: Product categorization frameworks, promotional copy, articles, photos, icons, and audio/video materials created by or for Palengkey.
2. Limited License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Palengkey platform strictly for personal, non-commercial purposes (e.g., browsing products, placing market orders, and managing your user account).
Restrictions: You may not, without our prior written consent:
- Reproduce, modify, distribute, sell, frame, or mirror any portion of our platform or content.
- Use the Palengkey logo, brand name, or trademarks in any commercial advertisement, domain name, or social media handle without authorization.
- Reverse engineer, decompile, or extract the source code of our web application.
- Use web scrapers, bots, or automated extraction tools to collect data, product lists, or pricing from our platform.
3. Partner Vendors and User-Submitted Content
Partner vendors and users may upload product images, descriptions, reviews, or special preparation instructions ("User Content").
- Ownership: You retain ownership of any intellectual property rights you hold in your User Content.
- License to Palengkey: By submitting content to our web app, you grant Palengkey a royalty-free, worldwide, non-exclusive license to use, display, reproduce, and adapt such content solely for the purpose of operating, marketing, and fulfilling orders on our platform.
- Responsibility: Vendors and users warrant that all content uploaded does not infringe on any third party's copyright, trademark, or proprietary rights.
4. Reporting Copyright Infringement
If you believe that your copyrighted work has been copied, displayed, or distributed on our platform in a way that constitutes copyright infringement, please submit a written notice to our designated Intellectual Property Officer containing the following information:
- Identification: A description of the copyrighted work you claim has been infringed.
- Location: The exact URL, link, or description of where the allegedly infringing material is located on the Palengkey platform.
- Contact Information: Your full name, mailing address, telephone number, and email address.
- Statement of Good Faith: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Signature: An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
5. Reporting Trademark Infringement
If you believe a vendor or user is unauthorizedly using your registered trademark on Palengkey (e.g., selling counterfeit items or using your brand name misleadingly), please notify us with:
- Details of the registered trademark (including registration number, if applicable).
- Specific location and description of the unauthorized trademark use.
- Proof of ownership or authorization to act on behalf of the trademark owner.
Upon receiving a valid notice, we will review the claim, temporarily remove or disable access to the infringing material if necessary, and notify the party that uploaded it.
6. Counter-Notification Procedure
If your content or product listing was removed due to a copyright or trademark notice and you believe this was done in error or misidentification, you may submit a written counter-notification to our contact address below. The counter-notice must include your contact details, identification of the removed material, a statement under penalty of perjury that the removal was a mistake, and your consent to local jurisdiction.
7. Repeat Infringer Policy
In accordance with Republic Act No. 8293 and internal risk policies, Palengkey reserves the right to terminate accounts or suspend vendor partnerships of users who are repeatedly determined to be infringers of third-party intellectual property rights.

2. Limitadong Pahintulot sa Paggamit (License)
Binibigyan namin kayo ng limitadong karapatan na i-access at gamitin ang Palengkey platform para lamang sa personal at non-commercial na layunin (tulad ng pagbili ng mga paninda, pag-order, at pag-manage ng inyong account).
Mga Bawal Gawin: Nang walang nakasulat na pahintulot mula sa amin, bawal ninyong:
- Kopyahin, baguhin, ipamahagi, ibenta, o i-reproduce ang anumang bahagi ng aming web app o content.
- Gamitin ang logo o pangalan ng Palengkey sa anumang negosyo, advertisement, o social media account nang walang pahintulot.
- I-reverse engineer o kunin ang source code ng aming system.
- Gumamit ng mga automated bots o scrapers para kumuha ng data o presyo ng mga produkto mula sa aming app.
3. Nilalaman mula sa Partner Vendors at Users (User Content)
Ang mga partner vendors at users ay maaaring mag-upload ng mga larawan ng produkto, deskripsyon, at mga pagsusuri (reviews).
- Pagmamay-ari: Mananatili sa inyo ang karapatan sa anumang orihinal na content na inyong ipopost o ie-upload.
- Pahintulot sa Palengkey: Sa pag-upload ng content sa aming app, binibigyan ninyo ang Palengkey ng libreng pahintulot na gamitin, ipakita, at i-reproduce ang nilalaman para lamang sa pagpapatakbo, marketing, at pagproseso ng mga order sa platform.
- Pananagutan: Tungkulin ng vendor o user na siguraduhing ang kanilang in-upload na larawan o teksto ay hindi yumuyurak sa copyright o trademark ng ibang tao o kompanya.
4. Pag-report ng Paglabag sa Copyright (Copyright Infringement)
Kung naniniwala kayo na ang inyong orihinal na gawa ay nakopya o ginamit sa aming platform nang walang pahintulot, maaari kayong magpadala ng opisyal na ulat sa aming Intellectual Property Officer na naglalaman ng mga sumusunod:
- Pagkakakilanlan: Deskripsyon ng copyrighted work na sinasabing nilabag.
- Lokasyon: Ang eksaktong URL o link kung saan makikita sa aming app ang sinasabing lumabag na materyal.
- Contact Information: Inyong kumpletong pangalan, tirahan, numero ng telepono, at email address.
- Pahayag ng Good Faith: Isang pahayag na naniniwala kayo sa magandang layunin na ang paggamit ng materyal ay walang pahintulot mula sa may-ari, sa agente nito, o sa batas.
- Kumpirmasyon ng Katotohanan: Isang pahayag na ang lahat ng impormasyong inyong ibinigay ay totoo at kayo ang may-ari o may awtoridad na kumatawan sa may-ari.
- Pirma: Pisikal o digital na pirma ng may-ari o ng awtorisadong kinatawan.
5. Pag-report ng Paglabag sa Trademark
Kung may nakita kayong vendor o user na gumagamit ng inyong rehistradong trademark (tulad ng pagbebenta ng pekeng produkto o maling paggamit ng inyong brand name) sa Palengkey app, mangyaring ipagbigay-alam sa amin kasama ang:
- Detalye ng inyong rehistradong trademark (kasama ang registration number kung mayroon).
- Lokasyon at deskripsyon ng maling paggamit ng trademark sa aming app.
- Katibayan na kayo ang may-ari ng naturang trademark.
Kapag natanggap ang valid na reklamo, aming susuriin ang kaso at maaari naming pansamantalang alisin ang produkto o content habang inaayos ang usapin.
6. Polisiya sa Paulit-ulit na Paglabag (Repeat Infringers)
Alinsunod sa Republic Act No. 8293 at sa aming mga internal na patakaran, may karapatan ang Palengkey na isara o tanggalin ang account ng sinumang user o partner vendor na mapapatunayang paulit-ulit na lumalabag sa intellectual property rights ng iba.
